THE PRACTICAL ANSWER
For a new Pahrump Basin domestic well, investigate the water-right relinquishment requirement and whether the parcel already has qualifying rights dedicated or relinquished. Get parcel-specific confirmation.
Start with the APN and basin
Pahrump town boundaries, the Pahrump Regional Planning District, a utility service area and the groundwater basin are different boundaries. Give the APN and legal description to the county, water provider and Nevada Division of Water Resources. Ask which rules apply to that exact location.
Establish the relinquishment history
Nye County Water District's Order 1293 guidance states that a relinquishment of two acre-feet of water rights in good standing is required for a new domestic well in the Pahrump Basin. It also notes that some lots already have rights dedicated or relinquished when created. Current order provisions and parcel history control the answer.
Request the underlying recorded dedication or relinquishment documents and NDWR confirmation. The state reference map is a starting tool; it is not a guarantee of drilling eligibility. Do not pay twice for something already documented, or assume a vague water-rights claim is sufficient.
Check public supply and actual construction
Ask the applicable provider for written service availability and connection requirements. For a proposed well, obtain a current licensed-driller estimate that distinguishes drilling, casing, testing, pump, power and any treatment. Confirm how dry-hole or extra-depth costs are handled.
For an existing well, review the log, equipment condition, performance and laboratory results. An installed well is not the same thing as a currently documented, adequate residential water system.
Put septic and the dwelling on the same plan
NDEP identifies Pahrump as a Nitrogen Management Area with advanced-treatment requirements in its onsite program guidance. Confirm the actual residential system requirements with Nye County Building and Safety for the parcel and proposal. Do not carry a conventional-septic price from a different location into this budget.
Leave room for well separation, drainfield and reserve area, setbacks, access and the building footprint. A new ADU proposal also needs current local and water review; Nye County adopted Pahrump ADU changes in 2026.
Questions to take to the agencies
- Is public supply physically and legally available here?
- What evidence establishes this parcel's dedication or relinquishment status?
- What current State Engineer order and exceptions apply?
- What wastewater design is accepted for this proposal?
- What would change if I add another dwelling or change occupancy?
